Step Away From the Keyboard (And Other Summertime Survival Tips)

?MOMentum-Monday-step-away-from-the-keyboard-and-other-summertime-survival-tips-banner

Anyone who knows me knows that I am a bit of a Type A personality (hence the weekly column called ?Momentum Monday? that focuses on time management and motivation). So what I am about to advise is going to be a bit of a shock: STEP AWAY FROM THE KEYBOARD (and put down your SmartPhone and don?t even think about pulling out the tablet on a technicality).

It?s summer. The sun is shining, the days are longer, the living is easy. Your family, your happiness, yourself needs you (all of you, not just the part of you that looks up from your computer)!?Your business needs you too, but that?s where the survival tips come in because it can hold on until the fall when the kids return to school and the weather turns yucky. In the meantime, take a vacation, give yourself a break, do something less productive!

Summertime Business Survival Tips?

#1: Scale Down the To-Do?s ? Forget your 2 to 3 must-do tasks and aim to get ONE thing done per day that you absolutely, positively must do or the world will come to an end. Focus on getting that done and then give yourself permission to clock out for the day.

#2: Get It Done Early ? Set your alarm clock and get your ONE thing done before the day gets rolling. That way you can enjoy the rest of the day guilt-free because you have already done what you set out to do that day.

#3: No Mommy-Tasking ? Don?t give in to the temptation to drag the laptop outside to get ?a bit of work? done while the kids play. Join the fun or do something you enjoy doing (like gardening). Remember, the summer is about giving yourself a break too.

#4: Manage Expectations ? Let your clients and customers know when you are available. Frustration happens when people expect things to carry on like normal and if you are running summer hours, that ain?t gonna happen so you may as well be upfront about it.

#5: Make Technology Work for YOU ? Use all your best tech tricks to keep things going without a lot of extra effort from you. If you had a time machine, I would recommend going back to the spring and getting all that organized beforehand, but since it?s not, best to just read this post on time-saving tools for twitter.

Live Review: Live in NYC by Jane's Addiction | Milky Tea Kid Music ...

Review by Jonny Garland

Jane?s Addiction ? Live in NYC

I used to be a big fan of Jane?s Addiction back in the day. But I sort of forgot about them, weirdly. I do this sort of thing; I forgot about my car on a shopping trip once and got a bus home, but that doesn?t mean I love it any less. For me, Jane?s Addiction were initially almost an acquired taste, a bit like soya milk. They seemed too ?psychedelic rock? for me at times, probably best enjoyed whilst dressed in robes and marginally off your face on strong coffee.

So I was looking forward to this latest offering from the Los Angeles guys. A live album, always a challenge, can they get the mix right? Will the atmosphere transfer from venue to my speakers and in turn to my ears? Some bands have failed badly in this respect. Not a lot beats ?being there?, smelling the sweat, and being jostled from every side whilst simultaneously being eardrum assaulted. However, it is safe to say that Jane?s Addiction have done it and they have done it well. ?Live In NYC? does not disappoint. It is Jane?s Addiction at their best; live, in your face, ABH?ing the ear in the best possible way. This album lived in my car for a week. In fact I almost forgot the reason it was there and this review I had to write.

The mix is good and the bass was pounding enough to shake my carammacchiatotto like a mild earthquake. Take Ain?t No Right for example. It?s the Addiction at their best with great bass, perfect guitar and clean vocals (for a live album), yet rough enough to remind you of the ?live? vibe and the sweat, blood and tears. In contrast new tracks like Irresistible Force (from the Great Escape Artist album) make an appearance and slow the proceedings down in a unique Addiction way. It is a track that I can only describe as quite beautiful. I think my neighbours like Ted, Just Admit it? judging by the banging on the wall in appreciation last night. It must have been Dave Navarro?s crisp guitar. Perry Farrell?s vocals are a little soft at times and slightly drowned out on occasion but don?t let that put you off. I feel that he is unique among vocalists and always has been, which is what makes Jane?s Addiction stand apart from the mainstream.

For a Jane?s Addiction fan this album is a must. For newbies just try it, go on. You will be surprised and you will love it. Stick it on, close your eyes and you will feel like you are there. Unless you are driving, I would not suggest that if you are driving? just speed up.

Flight attendants heroic actions focus of crash

SAN FRANCISCO (AP) ? Before Asiana Flight 214 crash-landed in San Francisco, the last time the Korean airlines' flight attendants made news it was over an effort by their union earlier this year to get the dress code updated so female attendants could wear trousers.

Now, with half of the 12-person cabin crew having suffered injuries in the accident and the remaining attendants receiving praise for displaying heroism during the emergency evacuation, the focus has shifted from their uniform looks to their heroic actions.

In the July 6 crash three members of the crew were ejected from the plane's sheared off tail section while still strapped in their seats. Those who were able, meanwhile, oversaw the emergency evacuation of nearly 300 passengers ? using knives to slash seatbelts, slinging axes to free two colleagues trapped by malfunctioning slides, fighting flames and bringing out frightened children.

"I wasn't really thinking, but my body started carrying out the steps needed for an evacuation," head attendant Lee Yoon-hye, 40, said during a news conference Sunday night before federal safety investigators instructed the airlines not to let the crew discuss the accident. "I was only thinking about rescuing the next passenger."

Such conduct has given a measure of pride to members of a profession who often are recognized only for their appearance and customer service skills.

"In the face of tremendous adversity and obstacles, they did their job and evacuated an entire wide-bodied aircraft in a very short period of time," said Veda Shook, international president of the Association of Flight Attendants and an Alaska Airlines flight attendant.

"It's such a shining reflection, not just of the crew, but of the importance of flight attendants in their roles as first responders," Shook said.

Along with training in first aid and firefighting, flight attendants every year are required to practice the moves needed to get passengers off a plane in 90 seconds or less, Shook said. They go through timed trials, practicing skills that include shouting over pandemonium and engine noise, communicating with people frozen in fear and opening jammed doors and windows, she said. The goal is to make performing these tasks automatic.

"We have the muscle memory," Shook said.

It's a significant departure from the days when flight attendants were always women and known as stewardesses or air hostesses. In that era decades ago, members of the cabin crew weren't expected to play much of a role in emergencies.

Laura Brentlinger, who spent 31 years as a United Airlines flight attendant, recalled having no idea how much danger everyone was in during one of her first emergency landings in 1972. She didn't realize the severity of the situation until it was over and she saw the pilot's face.

"In those days, it was like pat you on the head, just go back and keep the people nice and smile. That's how far we've come, thank the Lord," Brentlinger said. "We were just little Barbie dolls back there."

The role of flight attendants in the U.S. expanded significantly in 1989 after Air Ontario Flight 1363 crashed after taking off in Canada. An investigation revealed that a flight attendant had seen ice on a wing but did not speak up, assuming the pilots knew and would not welcome the information from her.

Since then, FAA rules have required that cabin crew members be incorporated into the communications system known as "crew resource management" that empowers all airline personnel to voice concerns to the cockpit even if it means challenging senior pilots.

The philosophy also authorizes flight attendants to order emergency evacuations. Hearing that the pilots of Asiana Flight 214 told the flight attendants to delay an evacuation for 90 seconds after the crash landing in San Francisco, giving the order only after a flight attendant spotted flames outside, made Brentlinger wonder whether Asiana Airline's attendants have the same authority.

"I'm sure they have a very different hierarchy and can't do anything without the pilot's permission," she said. "There is no doubt in my mind I would have evacuated that aircraft immediately."

Brentlinger said her heart aches when she thinks about what Asiana's flight attendants are going through now and are likely to go through in the months to come.

She was aboard a 747 that lost a cargo door at 22,000 feet, sucking nine passengers to their deaths over the Pacific Ocean in 1989.

After the disaster aboard United Flight 811, Brentlinger said she suffered severe post-traumatic stress disorder and was unable to get back on a plane for more than four years. Handling the emergency itself was "the easiest part of the whole process ... because you train for it and you just do it," she said.

She went on to say that "after the dust settles, so to speak" and one tries to get on with life, "it's horrific, at least it was for me."

The Flight 214 cabin crew consisted of 11 women and one man, ranging in age from 21 to 42, according to the airline. Spokeswoman Lee Hyomin said Asiana is not sharing information on emergency training hours of its flight attendants because the National Transportation Safety Board asked it not to share any information related to the accident while it's being investigated.

Jean Carmela Lim, 32, a Sydney-based travel consultant, spent a year working as an Asiana flight attendant eight years ago and posted pictures from her experience on her travel blog, Holy Smithereens, this week. She recalls her weeks-long safety training as rigorous.

"We needed to be able to swim while dragging another human ? dead weight ? in one hand, and hoist ourselves and the dead weight onto the safety raft," Lim said.

The appearance standards were almost as demanding. Lim, who was 23 when she applied for the job, initially was told she too old. During the interview, she was required to wear a short skirt without stockings. Flight attendant school included sessions on hair, makeup and comportment. During flights, the cabin manager inspected the attendants to make sure they were wearing the right color of nail polish and had their aprons properly ironed.

Lim said that appearance is important, but seeing pictures of Flight 214's attendants outside the burned-out aircraft in skirts made her hope their union prevails on the pants issue.

"If there's evidence that wearing a skirt will enable you to save more lives than wearing pants, then by all means keep them in skirts," she said. "If I'm trapped in a burning aircraft , I doubt I'll notice if the cabin crew saving me had lipstick on her teeth or had a tuft of hair out of place."

Leroy Comrie Drops Queens Borough President Bid

comrie

Councilman Leroy Comrie. (Photo: Facebook)

Councilman Leroy Comrie today announced an end to his bid for Queens borough president, citing ?personal matters? as his reason for leaving the race.

?After careful consideration, my family and I believe, due to personal matters, this is the best course of action,? Mr. Comrie said in a statement. ?I remain steadfast in my faith and belief in government and it is a true honor to continue to serve the people of Southeast Queens in my capacity as Councilman.?

Mr. Comrie surprised some in the political establishment when he decided to continue his campaign after the Queens Democratic Party in May endorsed a rival candidate, Melinda Katz. Despite mulling leaving the race, Mr. Comrie continued to score endorsements, including former Mayor David Dinkins, and held a campaign kickoff event last month on the steps of Queens Borough Hall.

Queens Democratic insiders weren?t sure about the legitimacy of Mr. Comrie?s campaign, however. Some had predicted, accurately ultimately, that he would eventually exit the race around the time when petitions were due to be handed in this week. He remains close to the county organization and would have complicated Ms. Katz?s path to victory against rivals like Councilman Peter Vallone Jr., a strong fund-raiser.

Mr. Comrie, who is term-limited, has been a rumored candidate for deputy borough president or even the sseat occupied by indicted State Senator Malcolm Smith. With his exit, only Ms. Katz, Mr. Vallone Jr. and State Senator Tony Avella remain in the Democratic primary.

?Queens is one of the greatest boroughs in ?our city, ?and I am thankful to everyone for the opportunity ?to showcase my ?platform for inclusion and empowerment and express my passion for the borough that was afforded me in this race,? Mr. Comrie said. ?I am looking forward to ?serving ?the people of Queens?in one capacity or another?for a long time to come.?

About to retire from teaching, Dell Parsons looks back 50 years and recalls his parents, their doomed union and the bank robbery that changed everything when he was only 15, passive and accepting, unlike his edgy fraternal twin sister, Berner, who ran away. Richard Ford?s languorous, slow-moving, rhythmic prose majestically serves this astonishingly heartfelt narrative. Dell?s father, Bev, a barely educated optimist, possessed Southern charm and little else, while his wife, Neeva Kamper, the only child of Polish immigrants, was a tiny, intense, quasi-bohemian, non-practising Jewish college graduate with literary pretensions to match her attitude of thwarted superiority. Ford, as ever exceptional on human behaviour, makes inspired use of the inept crime. Dell ponders the craziness of it all, ever mulling over his memories. The narrative is repetitive, to brilliant effect. Like a dog with a bone, Dell circles the facts, constantly probing, assessing, and debating with himself. Fiction seldom comes better than this American masterwork.

Rocket Girl: The Story of Mary Sherman Morgan, America*amp*apos;s First Female Rocket Scientist
George D. Morgan
Prometheus Books, 2013 ($18)

Morgan tells the fascinating story of his mother, Mary Sherman, who had only a high school diploma yet helped the U.S. launch its first satellite during the cold war. Talented in science and math, Sherman dropped out of college when a top U.S. munitions maker offered her a job designing explosives during World War II. Determined to keep working after returning soldiers claimed women's jobs, she applied to North American Aviation, where she invented the rocket propellant hydyne. Morgan, who based Rocket Girl on a play he wrote about his mother, re-creates dialogue and adds other creative flourishes that may put off some nonfiction readers, but the touches make for a dramatic, suspenseful tale.

Ants not surprised coach left for NBA

? Mad Ants president Jeff Potter knew he might lose his head coach as soon as he heard Dave Joerger took the head coaching job with the Memphis Grizzlies.

Joerger and former Fort Wayne coach Duane Ticknor have a strong friendship. Joerger used to be an assistant under Ticknor at the NBA Developmental League level.

Now, Ticknor and Joerger have swapped roles: Ticknor will be an assistant for the Grizzlies, while the 39-year-old Joerger tries to revamp a franchise.

And the Mad Ants are looking for a new head coach.

?I?m very happy for Duane. Well deserved ? he?s been as good as you get in our league for a long time,? Potter said. ?I?ll work with Duane and talk to him about some names, but we?re going to reach out to a few people that I think have been good coaches in our league, look for some different people as well.?

Potter is in Las Vegas for an NBA summer league this week and will speak with some coaches there. He is also considering Mad Ants assistant Steve Gansey, who is in Orlando with the Indiana Pacers for their summer league.

Gansey, who was an interim head coach for Fort Wayne and helped Ticknor lead the Mad Ants to their first playoff appearance, doesn?t have much experience in the lead role. But he is an option going forward.

?I?m going to have to talk with Jeff Potter and see what he?s thinking in terms of a head coach, and I guess we?ll kind of go from there,? Gansey said. ?We?ll just kind of wait and see what happens here in the next couple of weeks.?

But a decision on the next leader of the Mad Ants could take longer than that.

Potter said he has no timetable for a new hire, and he is more focused on finding the right person than filling the position quickly.

?Sometimes, you?re in these processes and you hear names that pop up that you didn?t think about,? said Potter, who will continue compiling a list of candidates this week. ?I?m not going to rush out there and hire someone that might not be the best fit. We?ll just kind of let it play itself out.?

The next head coach in Fort Wayne will come in under a new precedent.

The Mad Ants went 27-23 last season before losing in the first round of the NBA D-League playoffs. It was the first postseason appearance for Fort Wayne, and any incoming coach will have to try and build off that success.

Regardless of what?s in the future for the Mad Ants ? and for him ? this was a promotion Ticknor earned, Gansey said.

?I was excited for him,? Gansey said. ?He deserves it, you know? He?s been a lot of different places coaching basketball ? college, high school, the pros, overseas and everything.

?Now, he?s finally hitting the big leagues.?

European Union Antitrust Law and License Agreements: Proposed Changes to the Technology Transfer Block Exemption Regulation Threatens Several Widely-Used Contract Terms

Changes afoot

European antitrust law (often referred to as competition law) has tried for several decades to balance patent rights (which, until EU-wide patent rights are implemented, remain inherently country-specific) against the fundamental EU goal of having all member states function as a single market without internal barriers based on national boundaries. New draft legislation from the EU indicates that the patent rights/antitrust scales are being rebalanced in significant ways ? largely to the detriment of licensors.

Who needs to be concerned?

European competition law affects virtually all companies that do business in Europe or even simply grant licenses under European IP rights, regardless of whether the company is based in Europe. The fundamental competition law is set out in Article 101 of the Treaty on the Functioning of the European Union (Art. 101), which prohibits agreements and arrangements that restrict competition within the EU internal market, except in certain cases where the benefits to consumers outweigh the negative effects of the restriction. Art. 101 implicates most license agreements that involve licenses under European patent rights, database rights, know-how or similar IP.

Current safe harbor

Since 1984, the EU has attempted to provide a safe harbor with respect to certain common technology license arrangements that restrict competition (at least facially) but ultimately have pro-competitive effects. The safe harbor is established by the Technology Transfer Block Exemption Regulation (TTBER) and accompanying guidelines (Guidelines). Only companies that do not exceed designated market shares can rely on the TTBER. The current market share thresholds are a combined share of 20% for competitors and individual shares of 30% for non-competitors. However, companies that exceed the market share caps nonetheless should take the TTBER and Guidelines into account when reviewing their business arrangements because the TTBER and Guidelines shed light on how regulators are likely to apply EU antitrust law to specific arrangements.

Proposal for a new TTBER

Like all EU block exemption regulations, the TTBER runs for a certain number of years and then needs to be renewed. The?current TTBER?and?Guidelines?expire on April 30, 2014, and the EU is in the midst of reviewing and revising them. The European Commission has held two public consultations on a proposed?revised TTBER(New TTBER) and?guidelines?(New Guidelines), with the most recent consultation closing on May 17, 2013. Industry stakeholders have been paying close attention to the draft legislation. Both the Licensing Executives Society International (LES) and the Intellectual Property Owners Association (IPO) have submitted comments to the Commission. It remains to be seen whether the Commission will modify the New TTBER in light of the comments from industry and other stakeholders.

Key changes

The most contentious changes in the New TTBER include the following:

1. Challenges to validity.

As in the US, contractual terms prohibiting a licensee from challenging the validity of the licensed patents are generally understood in the EU to be unenforceable and potentially a violation of EU antitrust law (unless in a settlement agreement). However, in Europe, many licensing professionals consider it standard practice to provide that the licensor can terminate the license agreement if the licensee challenges the validity of the licensed patents. In fact, that precise scenario is contemplated by ? and implicitly endorsed by ? the current Guidelines (para. 113). The Commission is proposing to completely reverse its position on termination-for-challenge provision in Art. 5(1)(b) of the New TTBER, as further explained in para. 125 of the New Guidelines.

Even more surprisingly, non-challenge provisions in settlement agreements also have been put into doubt by paragraphs 226 and 227 of the New Guidelines, which state that the TTBER may not apply if there is doubt as to the validity of the patents in question or if the licensor makes a payment to the licensee. If the Commission?s current position is made law in the final New TTBER, the balance of power between licensors and licensees will be fundamentally changed. Settlement agreements, in particular, will be far trickier propositions ? and the legislation only has a temporary grandfathering period, which means that you may need to re-open existing settlement agreements

2. Grant-back provisions.

The current TTBER permits licensors to require that licensees license back, on an exclusive basis, new inventions made using the licensed technology that cannot be practiced without infringing the original licensed technology (known as ?severable improvements?). The New TTBER does not cover such grant-backs. This change is clearly to the detriment of licensors and the benefit of licensees.

3. Pay-for-delay.

The New Guidelines warn that settlement agreements between competitors that contain a payment from the licensor to the licensee are likely to fall foul of Art. 101. It appears that the Commission?s view on such ?reverse payments? was heavily influenced by its investigation of agreements in the pharmaceutical sector in recent years. Certainly pharma companies will be very concerned by this aspect of the New Guidelines. (It remains to be seen whether the Commission will be influenced by the US Supreme Court's recent holding inFTC v. Actavis that pay-for-delay provisions are not presumptively illegal.)

4. Passive sales window.

Currently, it is generally permissible under the TTBER to prohibit exclusive licensees in one territory within the EU to make passive sales (that is, sales initiated by the customer) into the territory of another exclusive licensee for the first two years after the launch of the product in that territory. The New TTBER would eliminate the current two-year grace period on bans on passive sales. This change is to the detriment of the later-established licensees in any given set of exclusive licensees, and also licensees in higher-priced countries within the EU (EU customers generally being savvy about cross-border comparison shopping).

Retroactive application to existing agreements

Once the final New TTBER is issued, companies will have until April 30, 2015 to bring existing agreements into line with the New TTBER. There is no specific exemption for settlement agreements, so companies could find themselves needing to re-open contentious discussions.

Steps companies can take now

We don?t know precisely when the definitive New TTBER and Guidelines will be issued, but we don?t expect them to be finalized for at least several months while the Commission sieves through the various comments from the recently-closed second consultation period. (At latest, the New TTBER will need to be published prior to the April 2014 expiration of the current TTBER.) For the time being, we suggest that companies review their existing agreements to determine which ones have an impact on the European market and will need to be analyzed once the final new TTBER and Guidelines are published.

Study: Brainpower in the very old may be improving

NEW YORK (AP) ? If you're lucky enough to live into your 90s, how well will your brain hold up? You may have an edge over people who got there ahead of you, a new study hints.

Researchers found that on tests of mental abilities, a group of 95-year-old Danes scored better than a group of Danes born 10 years earlier, who had been tested when they were about the same age.

In a standard simple test, for example, 23 percent of them scored in the highest category, compared to 13 percent of the earlier-born group. Out of the 30 questions and tasks, members of the later-born group averaged two more correct responses than the earlier-born group did. The results were released Wednesday by the journal Lancet.

Why the better mental performance? It wasn't just better education, but beyond that the researchers could only guess at things like more intellectual stimulation and better diets earlier in life.

More?people are living to such old ages. The U.S. census counted 425,000 Americans age 95 and older in 2010, a 26 percent increase over the total in 2000.

The mental testing compared 1,814 elderly Danes examined in 1998 to the later-born group of 1,247 Danes tested in 2010. The researchers also found that later-born Danes were better able to carry out basic living tasks like getting out of bed or a chair. So they were functioning better overall, the study concluded.

Lead author Dr. Kaare Christensen, head of the Danish Aging Research Center at the University of Southern Denmark in Odense, said he imagines that in the future, Danes who live into their 90s will continue to be better off than their predecessors. He was cautious about applying the results to the United States, although he said the availability of education in the U.S. after World War II would be a plus.

Dr. James Pacala, associate head of the department of family medicine and community health at the University of Minnesota Medical School, who didn't participate in the study, said he suspects the same trends are present in the United States.

He also said the findings fit with previous work that shows people are functioning better at given ages than they used to.

But Pacala, who heads the board of the American Geriatrics Society, noted that even in the better-functioning group of Danes, at least 40 percent and probably more had dementia.

Denise Park, an expert in mental function and aging at the University of Texas in Dallas, called the mental test results provocative but said it's not clear why the differences appeared. She said she would want to know if the effect holds up for 80-year-olds as well.

"If it's real, it should," she said.

FBI nominee says surveillance can be valuable tool

WASHINGTON (AP) ? The Obama administration's nominee to become the next FBI director, James Comey, told members of Congress on Tuesday that federal judges who oversee government intelligence programs are "anything but a rubber stamp." But Comey also agreed to work with legislators to improve the laws governing surveillance activities.

Comey said he wasn't familiar with the details of the government's phone and Internet surveillance programs that recently became public, but he said that collecting that type of information can be "a valuable tool in counterterrorism."

"Folks don't understand that the FBI operates under a wide variety of constraints," Comey told the Senate Judiciary Committee, which is considering his nomination for FBI director. He added that when critics discount the oversight of federal judges and call them a rubber stamp, it "shows you don't have experience before them."

Committee Chairman Sen. Patrick Leahy, D-Vt., said the expansive scope of the surveillance programs raises the question of "when is enough enough?"

"Just because we have the ability to collect huge amounts of data doesn't mean that we should be doing so," Leahy said.

The senator asked Comey if he would be willing to work with legislators "to enact some common sense improvements to our surveillance laws," and Comey agreed to do that if confirmed as FBI director.

In the aftermath of the uproar over NSA spying, Leahy has introduced legislation that would improve privacy protections and strengthen oversight and transparency provisions in U.S. surveillance programs.

Comey stepped carefully when asked what positions he would take as FBI director.

Sen. Charles Schumer, D-N.Y., asked Comey whether he would be willing to support declassifying or releasing declassified summaries of rulings by the Foreign Intelligence Surveillance Court.

"Senator, I agree with you that transparency is a critical value, especially when weighing tradeoffs between security and liberty," said Comey. "I think it is a worthy exercise to look closely at it."

Comey spent 15 years as a federal prosecutor before serving in the George W. Bush administration, where he is best known for facing down the White House over a warrantless surveillance program. The White House made changes in the program when Comey and current FBI Director Robert Mueller threatened to resign.

Comey got a warm reception from the both Democrats and Republicans on the committee, who repeatedly referred to his independence in standing up to the Bush White House.

Civil liberties groups have nonetheless expressed concerns that Comey signed off on abusive CIA interrogation techniques for terrorist suspects during the Bush administration, when he was the Justice Department's No. 2 official.

Comey told the committee that he argued strongly within the Justice Department against the interrogation techniques, telling the attorney general that "this is wrong, this is awful" and insisting that his arguments be presented to the White House. But his objections were overruled.

Leahy said he was concerned that while Comey was deputy attorney general under Bush, he approved a legal memo that authorized use of waterboarding "and other techniques long recognized as torture under both domestic and international law."

Comey explained that he regarded one Justice Department memo that said waterboarding would not violate federal law on torture as "a serious and reasonable opinion" about individual interrogation techniques.

Comey said he fought a subsequent legal memo that allowed a combination of harsh techniques to be used by CIA interrogators.

The second memo "was terrible. I thought it was irresponsible both as a policy matter and as a legal matter, and so I objected to it and took that directly to the attorney general and made my case that that was wrong. He disagreed with me and overruled me."

After leaving the Justice Department, where he served as the agency's No. 2 official, Comey was senior vice president and general counsel at defense contractor Lockheed Martin. He later became general counsel at hedge fund Bridgewater Associates. His financial assets include $5.2 million in securities and a home in Westport, Conn., valued at $3 million, according to financial statements filed with the Senate.

Spacewalkers leave space station for outside chores

CAPE CANAVERAL, Florida | Tue Jul 9, 2013 1:13pm EDT

CAPE CANAVERAL, Florida (Reuters) - Two astronauts left the International Space Station on Tuesday for a day of maintenance tasks, including installing a power cable needed for a new Russian laboratory due to arrive later this year.

Veteran NASA astronaut Christopher Cassidy and rookie partner Luca Parmitano, the first Italian to make a spacewalk, left the station's Quest airlock shortly after 8 a.m. EDT as the orbital outpost sailed about 260 miles over the Arabian Sea.

"Have fun out there," crewmate Karen Nyberg radioed from inside the station, a $100 billion research complex owned by the United States, Russia, Japan and 11 European nations, including Italy.

Cassidy's first task was to replace a failed backup component of the station's Ku-band communications system, restoring redundancy.

Parmitano, meanwhile, maneuvered himself to the right side of the station's solar power truss to pick up a pair of science experiments that will be returned to Earth aboard a future Space Exploration Technologies' cargo ship.

The privately owned California-based company, also known as SpaceX, is one of two U.S. firms hired by NASA to fly cargo to the station following the retirement of the space shuttles in 2011.

SpaceX's Dragon cargo capsules, which also are being developed to fly astronauts, are the only ones that return to Earth. Other cargo ships, including those flown by Russia, Europe and Japan, incinerate in the atmosphere after they leave the station.

The spacewalkers' to-do list also included repositioning some equipment delivered aboard a Dragon capsule in March. The gear - two grapple bars - may be needed by future spacewalkers tasked to remove station radiator panels.

Cassidy, who was making his fifth spacewalk, installed a power and data cable from the station's Unity connecting node to the Russian part of the International Space Station, completing one of the main goals of the outing.

The cable is part of a system that will be needed for a new Russian multi-purpose laboratory called Nauka that is due to launch later this year.

The new module will replace Russia's Pirs airlock, as well as serve as a research laboratory and berthing port. Russian cosmonauts will install the rest of the cable during a future spacewalk.

Cassidy and Parmitano have a follow-up spacewalk themselves next week to re-route cables that control the station's electrical system.

Pawsitively Pets: Feline Acne - How to Help Your Cat's Skin

I'm sure you're all familiar with acne... you know, annoying pimples and zits. Were you aware that cats could get acne problems with their skin as well? It's generally just called "feline acne" and it's a little different than human acne. Cats with feline acne have clogged glands or pores on their chin and around their lips. Cats with oily skin are predisposed to the condition.
This is something that's pretty common, and if you've ever had a cat maybe you've noticed this with them before. Is it harmful? Painful? How do you get rid of it or prevent it from happening? I have some advice that I'm going to share with you that may help your cat's skin.

What Is Feline Acne and Should You Be Worried?

Feline acne is probably not a life threatening condition. However, it can lead to discomfort and possibly infection if not treated. So maybe you should only be worried a little - no need for a trip to the emergency room at 3 am or anything.?

Cats have sebaceous glands around their chin and lips that release extra oils. These oils are thought to aid them while marking their territory. You know how cats like to rub their faces on things? Well, they are actually claiming their territory and saying "Hey! My oils have been rubbed on this, so that means it's mine!"?

The pores and glands in this area of the cat's skin are more oily and therefore more likely to become clogged. That is why we see cats develop acne in this area.?

How to Help Your Cat's Skin

If you suspect your cat has feline acne, there are a couple of things you can try. In most cases of feline acne, the area will need to be scrubbed with a chlorhexidine solution 2-3 times a day. This is the usual treatment for the condition. Of course, you should always talk with your veterinarian about a treatment plan.?

Sometimes, the feline acne can actually cause a secondary bacterial infection which may require oral antibiotics and maybe even topical antibiotic ointment. For severe cases of feline acne, a veterinarian may actually shave away the fur from the area so that it can be kept clean easier.?

You can also try to include a fish oil supplement to help with your cat's skin. Fish oil is a great source of Omega 3 fatty acids which are excellent for the skin.?

I've heard of a few home remedies for clearing up feline acne including cleaning the affected areas with apple cider vinegar, witch hazel, or hydrogen peroxide. I don't have any personal experience using these with feline acne, but they sound like they could be worth a try.?

It's also recommended that your cat does not eat from plastic food dishes. This can cause an allergic reaction in some kitties. Keeping your cat's food dishes clean is also important.?

Fortunately, I don't think I've ever seen an extreme case of feline acne before. It is a very common condition, however. Usually, most cases are mild and don't require intense treatment.?

Has your cat ever had this problem before? Do you have any good tips or advice for dealing with feline acne?

'Big Brother' viewers urge CBS to boot racists

TV

Cliff Lipson / CBS

Fans have had enough! On Sunday night, "Big Brother" finally aired a brief glimpse of some of the controversial content that made headlines recently, and viewers weren't happy with what they saw.

In fact, many viewers want to make sure they never have to see it again -- and not just due to clever editing. They want the players responsible for the offensive comments out of the house.

"CBS!!!!! After watching Sunday's show, 22 of us will not be watching any longer unless Arryn is kicked off the show," fan (or former fan) Rick Reimer said in a post on the official "Big Brother" Facebook page. "Her RACIST remarks cannot be allowed. We will also be boycotting any product that is advertised during the show. I hope others will follow our lead."

Reimer and his 21 unidentified allies weren't alone in the call to action.

Wendy Berry added, "It's funny how what three people have said on this show was bad enough that they've lost their job(s) however it's not bad enough to boot them off the show. Maybe the show should be renamed to Big Bigots."

Amy Williams agreed with the others, but also had a problem with CBS' decision to air the comments at all.

"Pretty sure that Aaryn should be kicked off the show for the slew of racist comments that were just shown on national television," show wrote to the same Facebook page. "Televising those comments should not have happened."

But according to some, CBS didn't go far enough. Sure, the network showed racist and homophobic comments from contestants Aaryn Gries and GinaMarie Zimmerman, but they didn't show the sexist or anti-Semitic comments Spencer Clawson has uttered in the house, or the numerous other inappropriate comments from other houseguests.

(Warning: The following video contains strong language.)

"Kaitlin Barnaby, Jeremy McGuire, David Girton and Spencer Clawson have also said things of the same nature," TODAY reader Godabed pointed out.

Katesus7 shared a similar sentiment on the "Big Brother" forums at Television Without Pity.

"They put it almost all on Aaryn, with one blink and you missed it comment by Gina Marie, they had several HGs give PC diary rooms about how offended they were, and not one word about all the other (expletive) said about Andy and the women by Spencer or Jeremy, who got off scott free," the viewer wrote. "Basically, CBS said 'oh, all right, enough people rose a stink so we'll give you your little segment. Now shut up and start voting for Spencer or Nick to win MVP!' It was just extremely unsatisfying. Although I guess it's still more than I thought they'd show."

"We are very mindful of the important issues that have been raised by these recent comments," CBS said in a statement shared with TODAY.com on Monday. "With regard to the broadcast version, we are weighing carefully issues of broadcast standards, an obligation to inform the audience of important elements that influence the competition, and sensitivity to how any inappropriate comments are presented.?

Host Julie Chen also said on "The Talk" Monday that the network chose to air the comments because they were now having an impact on the game play. "You can't just put it in there and say, 'Judge her, everybody," she said.

"When I first found out that Aaryn, who is a 22-year-old girl, made anti-gay, anti-black and anti-Asian comments, I have to be honest, the Asian ones hit me the most," she added about how the derogatory comments impacted her. "I took it personally. I'm a human being. The really sad part was it took me back to the '70s when I was growing up in Queens and when I was 7-years-old getting bullied, being called a chink and people pulling their eyes. ... I thought, 'Wow, I haven't heard comments like that (in a long time).' The year is 2013. ... I felt ignorant, there are still people in the country who feel that way and act that way? Yes there is ... it made me sad."

Just how the network should handle the problem was a point that had our readers torn last week. When we asked about it, 35 percent said the players involved should get the boot, but 45 percent thought they'd be satisfied if the footage in question aired. Another 18 percent thought the show should be canceled for the rest of the season. And then there was the 4 percent who thought the best policy would just be to ignore the increasingly difficult-to-ignore situation and not even air the controversy.

Amy McGranor Oviatt had a different idea that she shared on the show's official Facebook page -- let the predicament play out naturally.

"I think Aaryn is disgusting but just bc she said things that we dont agree with does not mean she should be kicked off," Oviatt wrote. "This is BB and that is the point of the show. She will totally get hers and i think that when Howard (Overby) calls her out for what she said and then she walks out to a booing crowd, AND has to answer to (host) Julie (Chen)....that will be sweet revenge and EVERYONE will tune in to watch her go down."

Livejournal user and Oh No They Didn't poster Evett had another, less feasible (and far less legal) solution: "Julie Chen needs to lock the doors from the outside and set that whole house on fire."

What do you think should happen? Click the "Talk about it" button below and share your thoughts.

Derry duo held after holy well and US tourists targeted by defecating Facebook party-goers

Two men have been remanded in custody after one of the Republic of Ireland's oldest monuments was desecrated and a holy well was defecated in during a drink-fuelled party organised on Facebook.

William Sweeney (19) and Raymond McCormick (21), both from Derry, admitted criminal damage at the monument in Burt, Co Donegal, when they appeared before Letterkenny District Court yesterday.

Police officer Eddie Doherty told Judge Paul Kelly of the "absolutely disgraceful scenes" at the fort last Saturday.

"Someone had actually defecated in a holy well which is beside the site, someone had defecated on the paths leading to the site and there was debris everywhere; everything from broken glass bottles to women's knickers, you name it, it was there," he said.

Doherty said the accused were mocking American tourists and had also targeted a Chinese family who had taken refuge in their car.

Patsy Gallagher, defending, said both clients were "deeply remorseful" for their behaviour.

The judge remanded the men to Castlerea Prison until Thursday.

Goth-themed wedding for Lavigne

Avril Lavigne has married Nickelback frontman Chad Kroeger

Chart star Avril Lavigne poses with a bouquet of black roses as she marries rocker Chad Kroeger at their goth-themed wedding.

The pair tied the knot at a chateau near Cannes in southern France, with Avril wearing a black Monique Lhuillier gown for the big day.

The Complicated singer - marrying for the second time - told Hello! magazine: "I had goosebumps from head to toe and my eyes filled with tears. It's a moment I will never forget as long as I live."

Avril was previously married to Sum 41 frontman Deryck Whibley for three years until she found love with Nickelback singer Chad.

She told the magazine: "My body was overtaken by emotion. I saw him and he was so calm and happy. He had a tear coming down and he wiped it away. I felt so good walking to him. It made me feel like a complete woman."

She said of the dark theme: "I wanted it to be over the top. I'm obsessed with castles and I love French decor and goth. I found this castle and it was perfect. I also wanted to make sure it was a crazy vacation and an experience of a lifetime for our guests."

Chad - who was marrying for the first time - proposed to Avril only a month into their relationship.

He said: "It felt like the stars had aligned. It felt like fate was intervening and I was being given this wake-up call: don't let this one get away. And I think she felt the same way and that's why I proposed in such a short time span - because we wanted to start our lives together."

:: The full interview appears in the new edition of Hello! magazine which is on sale now.

Mattrick tried to buy Zynga while still at Microsoft - report

Ex-Xbox chief Don Mattrick tried to tempt Microsoft bosses into buying Zynga years before his recent appointment as its CEO, a new report suggests.

Mattrick had eyes for Zynga as early as 2010, Bloomberg sources stated (thanks, GamesIndustry International), when he opened talks between Microsoft and the social games behemoth.

1

Biking buddies Pincus and Mattrick.

Negotiations took place during the height of the Facebook game boom, and it was at this point that Mattrick and previous Zynga boss Mark Pincus became pals.

While a deal was ultimately never reached, this moment lay the groundwork for Mattrick's eventual departure. He and Pincus remained in regular contact, and began discussing Mattrick's move in March this year.

Bloomberg's report stated that both men are avid road-bike enthusiasts, and the pair would often go riding together.

The Xbox head honcho eventually left following a storm of controversy over policies for Xbox One and an eventual, embarrassing U-turn on the ones that were most unpopular. Far from a knee-jerk reaction to Microsoft's troubles, Mattrick's departure appears to have been long planned.

As previously reported, Mattrick stands to earn $19 million during his first year at Zynga.

Weekend Roundup: Galaxy S4 sells 20 millions, Apple get sued over iDevices & Yahoo buys Qwiki

Yahoo acquires Qwiki

I?ve been following Qwiki for a while, ever since it won TechCrunch?s prestigious Disrupt award in 2010. The following year, it got a big funding pot from none other than the co-founders of Facebook and Youtube. I remember fondly playing with it while it was still available as a web-based service. The startup pivoted earlier this year becoming a mobile-only video app. Its core feature is converting pictures into video automatically complete with transitions and background music, similar to Animoto. In a nutshell, dare we say, it is a glorified version of the animated GIF, although its founder and CEO wants it to be a (visual) storytelling app. Too bad, it now has Vine (from Twitter) and Instagram?s latest video service, to compete with. Qwiki?s acquisition comes after Yahoo?s purchase of Tumblr in May but I fail to see how Marissa Mayer?s team will manage to integrate it into a coherent business plan. Unless, Yahoo is acting as a proxy for Microsoft and Qwiki will ultimately become a rival to the omnipotent Youtube.

Boston University looking for funding

Taking on some of the biggest companies in the world is no small feat and yet this is what the Boston University wants to do. This private research university has more than 4,000 faculty members, nearly 30,000 students and research expenditures reaching up to $553 million. After Amazon, Samsung and Google, Apple and its popular iDevices have been in the limelight after the university claimed Apple infringed on a patent filed by one of its professor 26 years ago. It wants sales of the iPhone, the iPad and the MacBook Air to stop until a licensing scheme is set up with the university taking a cut of each past sale. This is a classic case of patent-trolling, when an entity decides to pounce on a company to siphon using one or more patents, via a legal route.

EE and Mastercard will launch mobile wallet

The number of smartphones now coming with NFC capabilities is on the rise and mobile phone networks are starting to tap (pun intended) into that market. EE, the only 4G mobile network in the country, and global card processor Mastercard have announced that they will launch a mobile wallet contactless payment service. You can use the phone even when the battery has died (handy for paying a cab after a long night out) but you will need to pay into a prepaid account (up to ?20) first.

That?s probably the best option given that you won?t need a PIN to pay for that Greggs? croissant or your daily cappuccino fix. It will be interesting to see how the service behaves in real life especially as people now tend to carry more than one NFC-enabled products (e.g. oyster, bank card) and more phones integrated wireless charging.

Samsung sells 20 million Galaxy S4 smartphones

My back-of-an-handkerchief calculation shows that over the last 30 days, Samsung sold more than 330,000 units of its latest flagship, the Galaxy S4, with the Korean manufacturer claiming that it has flogged more than 20 million of them since it launched back in March. That has been helped partly by the fact that the average price of the S4 in the UK at least has been steadily falling. You can get the handset on a two-year contract for as little as ?29 per month with unlimited data while the phone itself costs as little as ?445, a far cry from the jaw-dropping ?600 it commanded when it went on sale.

African Union to Send Eminent Personalities Team to Egypt

VoA - News Sunday 7th July, 2013

An African Union team of eminent persons plans to meet this week with Egypt's interim leadership, following the ouster of the democratically elected President Mohammed Morsi.

"Egypt is an important member of the African Union and we would not in any way allow Egypt to degenerate into chaos. We would do all we could to ensure that Egypt remains stable and prosperous, God willing, rdquo; said Ambassador Aisha Laraba Abdullahi, the African Union's Political Affairs Commissioner.

Abdullahi also called for peace and reconciliation in Egypt following violent clashes between supporters and opponents of Mr. Morsi's ouster.

"We note with deep concern the violence that happened on Friday and the early morning of Saturday,rdquo; continued Abdullahi, "We hope that the human-rights violation, the use of firearm to control protesters should be strongly discouraged. We frown upon that and we call for peace for reconciliation for tolerance, so that Egypt could bounce back.rdquo;

Abdullahi's comments came after newly installed President Adly Mansour appeared to back away from an announcement that former Director General of the International Atomic Energy Agency, Mohammed ElBaradei would be made prime minister.

Photos Of An Alleged 'Budget iPhone' - Business Insider

Rumors have been circulating for months that Apple is working on a low-cost iPhone in a colored plastic case. Peripheral company Techdy claims it got its hands on one and last night it posted some video and a gallery of photos.

"The budget iPhone will be made substantially from plastic (we can feel it?s actually polycarbonate material). It will have a 4? screen, like the iPhone 5, and interestingly, the budget iPhone actually has a shape that?s similar to Apple?s original iPod," Techdy says of this phone on its blog.

As with other leaked photos of the device that Apple has not yet officially acknowledged, take these with a grain of salt. Also note that this alleged iPhone was the inspiration of a look-alike version that Techdy is selling. That's a $199 Android phone called "Basic Bear."

As for as how cheap this iPhone will actually be if it ever materializes, that's up for debate. Some reports say it could be as low as $99, though it's not clear if that would require a contract from a carrier or not.? At least one analyst thinks that the off-contract price would be?$350-$400, making it more of a mid-tier phone.

Here's some of the photos that Techdy just published.

Here's a comparison of the alleged budget iPhone and the iPhone 5.
